We function as joint controllers in relation to your personal data.

How We Collect or Receive Personal Data from You
Where we ask you to provide us with your personal data, we will indicate whether providing the personal data is a statutory or contractual requirement, or a requirement necessary to enter into and/or facilitate a contract, as well as whether you are obliged to provide the personal data and of the possible consequences of a failure to provide the personal data.
Fulgent Wellness gathers and obtains personal data from Visitors in several ways, such as:
Contacting us. When you contact us through the various communication channels provided on the “Contact Us” page of the Website, we collect personal data and other information that you provide. Affiliate/Member registration. Fulgent Wellness collects your personal data through the registration form that you complete and send to us in paper form or electronically through the FWC Website to become a registered member / affiliate / distributor.
Sponsor-initiated affiliate/member registration. Fulgent Wellness collects your personal data through the registration form that your member sponsor completes on your behalf, either sent to us in paper form or electronically through the FWC Website (i.e., Member portal) to become a registered member / affiliate / distributor.
Logged in as a member. If you are logged in on the Website as a member, we collect personal data that you provide to us while using the Website. For example, when you purchase products or services, we collect personal data.
Types of Personal Data We Process
Through Website cookies mentioned above under the section “How We Collect or Receive Personal Data from You”, we collect information regarding your Website usage, IP address, device type, browser type and operating system.
Also, when you communicate with us through various communications channels (e.g., Contact Us page, FWC-managed social media channels), we collect your contact details, such as your name, email address, address, telephone/mobile number, and/or fax number. You may also voluntarily provide other personal data in connection with your inquiries or comments. We encourage you, however, to provide no more personal data relating to you than is necessary for us to provide an appropriate response to your inquiries or comments.
For registered members, we process the following types of personal data related to you:
- Contact information (e.g., name, postal or e-mail address, social media handle / account / username / profile, telephone / fax /mobile number)
- Fulgent Wellness membership information (e.g., membership ID, membership rank, sponsor, sponsored members) and member username and password (NOTE: Passwords are immediately encrypted when stored and cannot be retrieved in decrypted form.)
- Demographics information such as gender, age, nationality, profession, date and place of birth
- Marital status
- National identifiers, such as passport or ID card (including number, issue date, issue location, and expiration date), tax identification number or social security number to the extent permitted or required by applicable law or if necessary for the performance of a contractual obligation
- Payment information, such as bank account, debit or credit card numbers, payment service providers (NOTE: Fulgent Wellness does not directly store credit or credit card numbers during online transactions, but instead securely transfers users to authorized third party payment gateway providers where user payment details are to be securely processed.)
- Fulgent Wellness membership performance information (e.g., rank, network and personal qualifications under the FWC PayPlan, and incentives history)
- Product preferences, purchasing habits, purchasing history, and spending behavior
- Communication preferences
We may process other personal data in exceptional circumstances only. If we need to process other types of personal data about you, we will make sure to inform you about the processing of such personal data and that there is a valid legal basis for doing so (e.g., your consent).
How We Use the Personal Data We Collect
We only process your personal data only to the extent necessary:

- To manage your relationship with us as a registered member / affiliate / distributor throughout your membership lifetime.
- To create and maintain your online membership account.
- To process your orders of products or services.
- To fulfill our obligation to provide business and product support to you.
- To communicate with you about products or services that we offer or intend to offer.
- To assess your performance under your Fulgent Wellness Agreement with us.
- To provide business performance information to you.
- To provide your contact information, business identification information, and business performance information to upline members, and contact information to downline members to support your business with Fulgent Wellness.
- To perform accounting, auditing, billing, collection, and delivery activities.
- To enforce contractual terms and conditions, including, without limitation, the applicable General and Membership Terms and Conditions.
How We Share Personal Data
Fulgent Wellness does not sell, rent, or trade your personal data. We do share your personal data among us as joint controllers and with:
- Other registered members directly related to you (i.e., your membership sponsor, upline, direct downlines) to support your business with Fulgent Wellness
- Providers of infrastructure- or platform- or software-as-a-service solutions, software development services, information system maintenance services, record management services or marketing services
- Financial transactions service providers
- Logistics and delivery providers
- Government authorities or other third parties, if required or allowed otherwise by law or necessary to protect the rights, legal interests, property, or safety of you, others, or ourselves
How We Protect Personal Data
We maintain appropriate technical and organizational security safeguards designed to protect the personal data we process against accidental, unlawful, or unauthorized destruction, loss, alteration, access, disclosure, or use.
As previously stated above in “Types of Personal Data We Process” section, membership user account passwords we collect are directly encrypted when stored into our systems and cannot be retrieved in decrypted form (meaning, we cannot read your password). Please note that Fulgent Wellness employees or contractors will not have access to unencrypted passwords and will never request user passwords from members for whatever reason. Members are responsible for maintaining their passwords and always keeping them secure.
How Long We Retain Personal Data
We store personal for the duration necessary to fulfil the purposes for which we collect the data (see above under “How We Use the Personal Data We Collect”), except if required or allowed otherwise by law. The Website, or FWC-managed social media channels published on the Website, may contain links to websites maintained by third parties, whose information and privacy practices are different than ours.
